Fencing Placement

Is there a law or Regulation covering the size and placement of fencing? I have seen a few but not many with open platforms for swim/fishing

My understanding is that all occupants are to be restrained inside the boat (within the Fencing) while it's underway or you may be found guilty of:

Negligent Operation

Negligent or Grossly Negligent Operation of a vessel which endangers lives and/or property is prohibited by law. The Coast Guard may impose a civil penalty for negligent operation. Grossly Negligent Operation is a criminal offense and an operator may be fined up to $5,000, imprisoned for one year, or both. Some examples of actions that may constitute negligent or grossly negligent operation are.

Operating a boat in a swimming area.
Operating a boat while under the influence of alcohol or drugs.
Excessive speed in the vicinity of other boats or in dangerous waters.
Hazardous water skiing practices.
Bowriding, also riding on seatback, gunwale, or transom.

That is what I was thinking, I guess the Coast Guard would be the place for answers, Such as would use of the trolling motor while fishing be considered underway? I see Bass Fisherman do it all the time (I understand that in itself doesn't make it legal)
