BWI = Boating While Intoxicated
CYA = Cover Your Ass
WP = Water Patrol
He's trying to say that the only reason they got the guy for for drunk boating is to deflect responsibility from the cops.
I don't know the full story, but if the Patrol Boat struck the other boat on the starboard side, it indicates to me that that the Patrol Boat was in the other boat's "danger zone" making the Patrol boat the stand-on vessel (has right of way) and the civilian boat the give-way vessel.
There are probably other factors, including the responsibility for all vessels to use take necessary action to avoid collision, but based solely on Navigation Rules, it appears that the civilian boat was the primary cause of the collision.
And although the "official" BAC test may not be back from the Police lab yet, the hospital would have taken blood tests in the ER and the BWI would have been based on the hospital's results. Good enough to charge, but may not be able to be used at trial, hence the sample sent to the official police lab.
