Marine guns....

This is a little off topic,
But do of any of you guys in free America keep guns on board?

Here behind the iron curtain, most of our lakes are in state parks, so fire arms are big no-no.

Which is a shame since I actually own a Winchester marine model in 12 gauge....shiny nickel plated with a polished stainless steel barrel.

When ever I get the salt boat, it will come aboard, now its just a safe queen.

I don't bug I've heard of many people who do. Especially if they fish far offshore. I've read a couple accounts of attempted pirating. I believe open carry is allowed in Florida while boating.

Not on all lakes,there is a small lake near me, you can walk around Lake Underhill with a gun but you can't take it on a boat on the lake, I did think they finely changed the law having a gun on rivers that run through State Parks, but I wonder how many more lakes you can't have a gun on.

I found this don't know if it true or not

State laws differ, so refer to your local law-enforcement agency. I consulted Capt. Robert Moore of the Florida Fish and Wildlife Conservation Commission, the top marine law-enforcement group in Florida. Moore is also this year's president of the National Association of State Boating Law Administrators. He says that in Florida the same firearms laws apply on land and sea.

One of those laws states that you can't carry a concealed weapon without the proper permit. However, the Florida legislature specifically made it legal to transport and use firearms while fishing and hunting. You can carry a firearm in your boat or car, but it must be in a secured (locked) case.

Then I found this too, guess we need to keep checking the laws

HB 45, signed into law in July by Gov. Rick Scott and put into effect Oct. 1 as part of Florida Statute 790.33. The intent of HB 45 was to make it easier for gun owners to carry weapons from one jurisdiction to another. It forcefully reasserted the 1987 law that reserved the right to set gun policy strictly to the state, making all local gun laws or rules “null and void.” And it threatened any local official who tried to enforce a local gun ordinance with a $5,000 fine and removal from office.

Only state law applies when it comes to guns.

I think that I should always open-carry a very high-power rifle on board, because I heard of this constitutional amendment thing that grants the right to arm bears...and an armed bear on my boat would be a very terrifying situation. Would he force us to fish for his dinner? Would he drink all my Crown Royal? There are so many tragic scenarios here, that I MUST be able to fight back!

There's very few places that I'm not armed, in one way or another.

In my line of work, I don't have to worry about those pesky concealed carry laws.

We've had this discussion up nort a few times. If Ranger Smith can carry his S&W sidearm to ward off bears and Conservatives, why can't I? I sleep on the boat in his stinkin' park all the time. Bears are a constant concern as there are LOTS of 'em. They are not aggressive, but they do like beer. I worry about Yogi and BooBoo joining me on board at three in the morning and raiding my stash.
But noooooo. I would have to fend him off with my Leatherman.

You are limited while open carrying your legally purchased handgun in the fine state of Florida. This is covered under Florida Statute FS 790.053. There are exceptions to the statute. It is legal to open carry when hunting, fishing, trapping, and while at work. This is covered under FS 790.25(3)(h), (j) and (k). "Anyone, while fishing, camping, or hunting....or while going to, or coming from fishing, camping, or hunting is exempt from the prohibition on open carry."

I haven't seen a lot of pick up trucks with the gun racks like I used to. Is this going out of style with the red necks? :lol3 :lol3 :lol3 Also haven't seen those huge confederate flags flying around. Are we now being politically correct?

They took them out of the trucks because they got to be worth money and aholes were stealing them, look how many police weapons they stole from police cars, they got a few of the full auto machine guns, so you think they going to respect anyone else's cars and trucks if their hitting police cars

When possible, yes I carry. I spend a lot of time boating and camping in the middle of no where and have run across my share of crazies out in the sticks along with black bears out in the sticks. Never have needed it and I hope I don't but I can guarantee I practice more than most small town cops do.

It's legal to carry concealed loaded, without a permit, if you are actively fishing, if its legal to have a firearm on you at the location you are at. So this bans most of the places we could fish.

I think the viable place would be the river, the Colorado, there I always have somethng on me, even if its LUCC, locked unloaded concealed carry, since out there it can be no-mans land sometimes, right BoatCop?

The Colorado River is unusual when it comes to conflicting laws. There is no "side" of the river on the water, as in Arizona side or California side. A Compact between the states allows Arizona Officers to enforce their laws, and Arizona Courts to prosecute anywhere on the River up to the high water line of the opposite shoreline, and vice-versa for California Officers/Courts.

The interstate compact for jurisdiction on the Colorado river is enacted into law as follows:

Section I. Concurrent Jurisdiction

A. If conduct is prohibited by two adjoining party states, courts and law enforcement officers in either state who have jurisdiction over criminal offenses committed in a county where the Colorado river forms a common interstate boundary have concurrent jurisdiction to arrest, prosecute and try offenders for the prohibited conduct that is committed anywhere on the boundary water between the two states and concurrent jurisdiction to arrest offenders for prohibited conduct that is committed on any land mass within twenty-five air miles of the Colorado river or within twenty-five air miles of any lake that is formed by or is a part of the Colorado river.

B. This compact does not authorize:

1. Prosecution of any person for conduct which is lawful in the state where it was committed.

2. Any conduct prohibited by any party state.

How does this come into play for Concealed Weapons?

As everyone knows, it's near impossible to get a CCW permit in CA (County Sheriff's are responsible for issuing) and even possessing a (loaded) gun in CA is generally illegal.

But in AZ anyone (who is not prohibited from possessing a gun) can carry concealed just about anywhere without a permit or license.

So based on #1 above, prosecution isn't permitted if it's lawful in the state committed (definitive proof would have to be made that it actually was within the state's jurisdictional boundary)

But then again #2 doesn't permit the conduct since it is prohibited by one state.

So the compact makes carrying a concealed weapon illegal on the entire River, based on CA laws, but doesn't allow prosecution based on AZ laws.

Yeah, I know it's confusing and does create some hurdles for law enforcement on the River. Most CA officers would enforce it based on residence and boat registration of the individual.

Move to Virginia. Open carry state, CCW permits are shall issue, can carry concealed with permit even during hunting season.

thats is the easy way out,

I'll rather stay here and support the cause from the inside.

But if were to leave Ca, Virginia, and the Carolinas are on the top of my list.
